How to make a valid gift
- Fill the deed. Donor, donee, relation and what is gifted.
- Stamp paper. Print on stamp paper of the value fixed by your state (many states give a lower rate for family gifts).
- Sign and attest. Donor and donee sign; two witnesses attest.
- Register (property). A gift of immovable property must be registered at the Sub-Registrar office.
Common questions
Is a gift taxable?
A gift from a relative (spouse, brother, sister, parents, children, grandparents, their spouses and some others defined in the Income-tax Act) is fully exempt. Gifts from non-relatives are taxable in the receiver’s hands if they exceed ₹50,000 in total in a year. Gifts on marriage and by will are exempt.
Is registration compulsory?
For immovable property, yes — the gift must be by a registered deed, signed by the donor and attested by two witnesses (section 123, Transfer of Property Act). For money or movables, registration is optional; delivery and a signed deed are enough.
Can a gift be cancelled later?
A completed gift is generally irrevocable. It can be revoked only in limited cases, such as an agreed condition in the deed or where it was obtained by fraud or coercion (section 126, Transfer of Property Act).
Will income from the gifted asset be clubbed?
Yes, if the gift is to the spouse or son’s wife — the income is added to the donor’s income. Gifts to adult children or parents are not clubbed.
