Common questions

Why are most rent agreements for 11 months?

A lease of more than 11 months (a year or more) must be registered under the Registration Act, which costs stamp duty and registration fees. Agreements up to 11 months are usually not registered — except in Maharashtra, where every leave and licence agreement must be registered.

When must the tenant deduct TDS on rent?

If rent is more than ₹50,000 a month. An individual / HUF tenant not covered by audit deducts 2% once a year; a business tenant deducts 10% on building rent (2% on machinery) — section 393 of the Income-tax Act, 2025.

Is GST payable on rent?

On commercial property, yes at 18%, if the landlord is GST-registered. Rent of a residential house for living is exempt, except when it is let to a GST-registered person, where the tenant may pay GST under reverse charge.

Can I claim HRA with this agreement?

Yes. Keep the agreement and rent receipts. If yearly rent is above ₹1 lakh, give the landlord’s PAN to your employer.
