How to set up an HUF
- Make the declaration. Fill the form and download the deed.
- Sign on stamp paper. Print page 1 on stamp paper of the value fixed by your state; Karta, adult members and two witnesses sign. Notarisation is advised.
- Apply for PAN. Apply for the HUF’s PAN online (Form 49A) with this deed and the Karta’s ID and address proof.
- Open the bank account. Open a savings account in the HUF’s name and deposit the corpus by cheque or transfer.
Common questions
Who can form an HUF?
Hindus, Jains, Sikhs and Buddhists. An HUF comes into existence on its own with marriage; this deed records it in writing for the PAN, bank and tax department.
Can a daughter be a coparcener?
Yes. Since the Hindu Succession (Amendment) Act, 2005, a daughter is a coparcener by birth, with the same rights as a son. She stays a coparcener even after marriage.
Where can the HUF’s initial money come from?
Common sources are gifts received at marriage, gifts from relatives who are not members, or property received by will or inheritance. If a member gifts money to the HUF, the income from it is added to that member’s own income (clubbing).
Does an HUF save tax?
Yes. An HUF is a separate taxpayer with its own basic exemption and slab rates, so income on HUF property is taxed separately from the members’ income.
